These terms govern your use of the salesandleasing.com.au website and agent matching service. By using the site or submitting an enquiry, you agree to them. This page is maintained by salesandleasing.com.au and may be updated from time to time.

1. Who we are

salesandleasing.com.au is a subsidiary of Nobul Group Pty Ltd, ABN 65 700 864 777, of Level 12, 197 St Georges Terrace, Perth WA 6000 ("we", "us", "our"). References to salesandleasing.com.au in these terms mean Nobul Group Pty Ltd trading as salesandleasing.com.au.

2. What our service does

We are an agent matching and referral service. When you tell us about your property, we may shortlist up to three real estate agents or property managers from our network whose recent performance suits your property, and introduce you to them. We are not a real estate agency, we do not sell or lease your property ourselves, and we do not act as your agent in any transaction.

Our service is free for property owners. We are paid by the agency on successful completion of a sale or lease. Every agency in our network is charged the identical fee, and no agency can pay to be shortlisted or ranked more favourably.

3. Not advice

Information on this site, including our guides, commission ranges, fee estimates and market commentary, is general information only. It does not take into account your particular circumstances and is not legal, financial, taxation, valuation or property advice. You should obtain your own professional advice before making any decision about selling, leasing, pricing or appointing an agent.

4. Agents in our network

Agents and agencies introduced through our service are independent third parties. Any agency agreement, management agreement, commission, marketing schedule or other contract is entered into directly between you and that agency, on terms you agree with them.

While we select agents using performance data and negotiate capped fee arrangements across our network, we do not guarantee any particular sale price, rental return, timeframe, outcome, or standard of service, and we are not responsible for the acts or omissions of any agent or agency. Complaints about an agent's conduct should be raised with that agency and, where appropriate, the consumer protection or real estate regulator in your state or territory. We would also like to hear about it.

5. Your obligations

• Provide accurate and complete information about yourself and your property.
• Only submit an enquiry if you are the owner of the property, or are authorised by the owner to do so.
• Do not use the site unlawfully, attempt to interfere with it, scrape it, or use it to send unsolicited communications.
• Do not copy, republish or commercially exploit our content without our written permission.

6. Enquiries and contact

By submitting the enquiry form, you consent to us contacting you about your enquiry by phone, SMS or email, and to us sharing your enquiry details with the agents we shortlist so they can contact you. You can ask us to stop at any time by emailing sam@salesandleasing.com.au. How we handle your information is set out in our Privacy Policy.

7. Intellectual property

All content on this site — text, guides, graphics, layout, and the salesandleasing.com.au name and branding — is owned by or licensed to Nobul Group Pty Ltd and is protected by copyright and trade mark law.

8. Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited to resupplying the service or paying the cost of having it resupplied.

Otherwise, to the extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for loss of profit, opportunity or expected sale or rental proceeds, arising from your use of the site or from any dealing with an agent introduced through it.

9. Third party links

The site may link to third party websites. We do not control them and are not responsible for their content, products or privacy practices.

10. Changes and termination

We may change these terms, or change or discontinue any part of the site or service, at any time. Continued use after a change means you accept the updated terms. We may decline to provide the service to anyone.

11. Governing law

These terms are governed by the laws of Western Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
